Call for expressions of interest

 2.Type of notice — Call for expressions of interest:
Companies interested in the contracts, the object of which is described in point 3.1 of this notice, are invited to submit a request-to-participate dossier. This dossier shall comprise the documents listed in point 7.The contracting authority will include in a list those candidates meeting the criteria in point 7. This list will be broken down into sub-lists corresponding to the lots covered in point 3.1.For each contract specific to 1 of the fields described in point 3.1, the contracting authority will either send an invitation to tender to all the candidates on the corresponding sub-list, or to some of them selected on objective and non-discriminatory preselection criteria specific to the contract concerned.The list resulting from this notice will be used solely for contracts which fall outside the scope of Directive 2004/18/EC.
 3.1.Full description of the fields covered by the call for expressions of interest:
CPV code(s):55520000-1 Catering services55300000-3 Restaurant and food-serving servicesThis call for expressions of interest involves the provision of catering services for the President of the European Council, for the General Secretary of the Council of the European Union, and for diplomats and senior civil servants of the General Secretariat of the Council of the European Union, outside of the buildings of the General Secretariat of the Council of the European Union in Brussels.This call is divided into 3 lots:lot 1: restaurants providing very high quality meals for formal occasions: restaurants providing very high quality meals for formal occasions, based on various types of European Union cuisine, as well as providing a high level of service. Interested restaurants must be located within a 30 km radius of the head office of the General Secretariat of the Council of the European Union (a 10 % margin will be allowed), rue de la Loi 175, 1048 Brussels. The restaurants must either have a separate room available to accommodate at least 40 persons, or be able to offer exclusive use of the restaurant for the duration of the meal. A private parking area is required or, if not, a car collection and parking service; lot 2: restaurants for working meals: restaurants providing working meals based on various types of European Union cuisine and offering good quality service. Interested restaurants must be located within a 2 km radius of the head office of the General Secretariat of the Council of the European Union, rue de la Loi 175, 1048 Brussels, and be able to accommodate groups of up to 12 persons in a separate room;lot 3: caterers providing very high quality meals for formal occasions: caterers providing very high quality meals for formal occasions for 2 to 40 persons. The meals shall be based on various types of European cuisine. Interested caterers must be located, or be able to organise provision of meals, within a 30 km radius of the head office of the General Secretariat of the Council of the European Union (a 10 % margin will be allowed), rue de la Loi 175, 1048 Brussels.
 3.2.Details of the type of contract to be competed for on the basis of the list:
The contracts to be competed for on the basis of the sub-lists drawn up will involve services.
 4.Place of delivery of the supplies, performance of the works or provision of the services:
Brussels and surrounding area.
 5.Expiry date of the list resulting from the call for expressions of interest:
The list will remain valid for 3 years from the date of dispatch of the notice to the Publications Office. The request to participate dossier may be submitted at any time prior to the last 3 months of the list's validity period.It is estimated that the first invitation to tender will be launched 6 weeks after publication of this call for expression of interest. Expressions-of-interest dossiers received after this date will therefore be taken into consideration for subsequent invitations to tender. All candidates will be notified of the outcome of their expression of interest.
 6.Participation of a grouping of candidates and subcontracting:
Participation is open to all legal entities participating individually or as part of a grouping of candidates. A grouping may be a permanent grouping with legal status or an informal grouping created with a specific invitation to tender in mind. All the members of a grouping (i.e. lead company and all other partners) must be jointly and severally liable vis-à-vis the contracting authority. Groupings must specify the name of the lead company and of the sole contact person responsible for the running of the invitation to tender procedure. They must also submit a copy of the documents (proxy) authorising this company and this person to tender or to sign a contract on behalf of the grouping. All members of the grouping must provide the documents indicated in point 7.Tenderers intending to subcontract must indicate in their tender which part of the contract will be subcontracted and the name of the proposed subcontractor. The conditions for subcontracting shall be defined in the specifications. The Secretariat reserves the right to require that subcontractors provide the documents indicated in point 7.
 7.Exclusion and selection criteria — List of documents to be provided

7.1. Exclusion criteria:

To prove that they are not in any of the situations referred to in Articles 93 and 94 of the Financial Regulation applicable to the general budget of the European Communities, candidates must provide a solemn declaration, duly signed and dated by a legal representative of the company. A consolidated version of this regulation is accessible on the EUR-Lex site (http://eurlex.europa.eu/LexUriServ/LexUriServ.do?uri=CONSLEG:2002R1605:20071227:FR:PDF).

Pursuant to the Financial Regulation, candidates will be excluded from participating in a procurement procedure if they:

(a) are bankrupt or being wound up, if their affairs are being administered by the court or if they have entered into an arrangement with creditors, if they have suspended business activities, if they are the subject of proceedings of this nature or if they are in any analogous situation arising from a similar procedure under national laws or regulations;

(b) have been convicted of an offence concerning their professional conduct by a judgment which has the force of res judicata;

(c) have been guilty of grave professional misconduct proven by any means which the contracting authorities can justify;

(d) have not fulfilled their obligations to pay social security contributions or taxes in accordance with the legal provisions of their country of residence or with those of the country of the contracting authority, or those of the country where the contract is to be carried out;

(e) have been the subject of a judgment which has the force of res judicata for fraud, corruption, involvement in a criminal organisation or any other illegal activity detrimental to the Union's financial interests;

(f) are currently the subject of an administrative penalty (exclusion from contracts financed from the budget of the European Union for a maximum period of 10 years):

— either because they have been guilty, during another contract procedure, of misrepresentation in furnishing the information required by the contracting authority in order to take part in the contract in question, or have not furnished said information,

— or because they have been declared to be in serious breach of contract following a different contract procedure from the one in this call for expressions of interest.

In addition, candidates will be excluded from contract award if, at the time of the procurement procedure for this contract, they:

(g) are in a situation where interests conflict;

(h) are guilty of misrepresentation in furnishing the information required by the contracting authority in order to take part in the contract, or have not furnished said information.

The aforementioned solemn declaration must clearly state that the candidate is not in any of the situations described in (a), (b), (c), (d), (e), (f), (g) and (h).

7.2. Selection criteria:

In addition, in order to assess their economic and technical capacity, candidates must enclose the following documents with their request to participate dossier.

7.2.1. For lot 1: restaurants providing very high quality meals for formal occasions:

(a) proof of access to the profession;

(b) a copy of the authorisation issued by the Agence fédérale belge de sécurité de la chaîne alimentaire — AFSCA (Belgian federal agency for food safety);

(c) the restaurant must comply with the relevant requirements for its activity regarding food hygiene, food safety and traceability stipulated in Regulation (EC) No 178/2002 of the European Parliament and of the Council and Regulation (EC) No 852/2004 of the European Parliament and of the Council;

(d) proof that the candidate has a private parking area available with a capacity for at least 10 cars or alternatively that he can provide a car collection and parking service;

(e) proof that the restaurant has a private room available with capacity for at least 40 persons or, if not, that the entire restaurant can be reserved without changing the conditions offered (standard menu price per person);

(f) a dossier containing the following information:

1) a list of at least 2 significant references (customers) over the past year (companies, institutions, ministries, embassies, etc.);

2) photos of prepared dishes and tables;

3) photos of the premises where dishes are prepared;

4) a list of their suppliers;

5) information about their personnel, who must be able to speak English or French.

The General Secretariat of the Council (GSC) reserves the right to contact references directly and to consult guides such as the Michelin guide, the Delta guide covering Brussels and the surrounding area, and the Brussels' Eurodistrict Restaurants guide, which demonstrate the capacity to organise meals, taking account of:

1) the quality of the meals;

2) the capacity to ensure an efficient service;

3) hygiene conditions;

4) the freshness of the products;

5) the decor and atmosphere of the restaurant;

(g) the basic offer for a typical menu, including drinks, excluding VAT (amount excluding VAT if the bill is greater than 124 EUR): for a menu of no more than 150 EUR per person. The menu must comprise: aperitif and drinks, cold and/or hot starter, main dish, dessert and coffee (covering the usual requirements of a typical customer: fish, meat, vegetarian);

(h) only candidates located within a 30 km radius (10 % margin allowed) of the General Secretariat of the Council of the European Union (rue de la Loi 175, 1048 Brussels) will be selected.

7.2.2 For lot 2: restaurants for working meals:

(a) proof of access to the profession;

(b) a copy of the authorisation issued by the Agence fédérale belge de sécurité de la chaîne alimentaire — AFSCA (Belgian federal agency for food safety);

(c) the restaurant must comply with the relevant requirements for its activity regarding food hygiene, food safety and traceability stipulated in Regulation (EC) No 178/2002 of the European Parliament and of the Council and Regulation (EC) No 852/2004 of the European Parliament and of the Council;

(d) proof that the restaurant has a private room available with capacity for at least 12 persons or, if not, that it can offer a partially private space without changing the conditions offered (standard menu price per person);

(e) a dossier containing the following information:

1) a list of at least 2 significant references (customers) over the past year (companies, institutions, ministries, embassies, etc.);

2) photos of prepared dishes and tables;

3) photos of the premises where dishes are prepared;

4) a list of their suppliers;

5) information about their personnel. Some of the personnel must be able to speak English or French.

The GSC reserves the right to contact references directly and to consult guides such as the Michelin guide, the Delta guide covering Brussels and the surrounding area, and the Brussels' Eurodistrict Restaurants guide, which demonstrate the capacity to organise meals, taking into account:

1) the quality of the meals;

2) the capacity to ensure an efficient service;

3) hygiene conditions;

4) the freshness of the products;

5) the decor and atmosphere of the restaurant;

(f) the basic offer for a typical menu, including drinks, excluding VAT (amount excluding VAT if the bill is greater than 124 EUR): menu costing no more that 60 EUR per person, for meals for 2 to 12 persons. The menu must comprise: aperitif and drinks, cold and/or hot starter, main dish, dessert and coffee (covering the usual requirements of a typical customer: fish, meat, vegetarian);

(g) only candidates located within a 2 km radius of the head office of the General Secretariat of the Council of the European Union (rue de la Loi 175, 1048 Brussels) will be selected.

7.2.3 For lot 3: caterers providing very high quality meals for formal occasions:

(a) proof of access to the profession;

(b) a copy of the authorisation issued by the Agence fédérale belge de sécurité de la chaîne alimentaire — AFSCA (Belgian federal agency for food safety);

(c) the caterer must comply with the relevant requirements for its activity regarding food hygiene, food safety and traceability stipulated in Regulation (EC) No 178/2002 of the European Parliament and of the Council and Regulation (EC) No 852/2004 of the European Parliament and of the Council;

(d) a dossier containing the following information:

1) a list of at least 2 significant references (customers) over the past year (companies, institutions, ministries, embassies, etc.);

2) photos of prepared dishes and tables;

3) photos of the premises where dishes are prepared;

4) a list of their suppliers;

5) information about their personnel. Some of the personnel must be able to speak English or French.

The General Secretariat of the Council reserves the right to contact references directly;

(e) the caterer must send us a description of his basic offer for a typical menu, including drinks, excluding VAT (amount excluding VAT if the bill is greater than 124 EUR): for a menu of no more than 150 EUR per person. The menu must comprise: aperitif and drinks, cold and/or hot starter, main dish, dessert and coffee (covering the usual requirements of a typical customer: fish, meat, vegetarian).

7.2.4.

Candidates should note that failure to provide sufficient information for the aforementioned points may lead to their dossier being rejected.

The inclusion of a candidate on the list mentioned in point 2 above does not oblige the General Secretariat of the Council either to award him the contract or send him an invitation to tender.
