 1.Contracting authority:

 2.Notice of call for expressions of interest:
DGT wishes to establish a list of suppliers of subscriptions to periodicals in any format.Economic operators interested are invited to submit a request in accordance with the provisions set out in this notice and the purposes stated therein.The contracting authority will draw up a list of candidates who meet the criteria set out in point 7 below.Each time a specific contract is to be concluded relating to the field described at point 4, the contracting authority will invite all the candidates on the list, or some of them, selected on the basis of objective and non-discriminatory criteria, to submit a tender.Inclusion on the list entails no obligation on the part of the European Commission concerning the award of a contract nor, in view of the preceding paragraph, concerning an invitation to tender.

The list resulting from this notice will be used exclusively for public supply contracts worth less than an estimated 125 000 EUR.

Periodicals to which subscriptions are to be procured may be general or specialised in the fields covered by the European Union policies, and in paper or electronic format (CD/DVD-ROMs, databases). They will be in any of the official languages of the European Union, in any of the official languages of the candidate countries or in any of the non-EU official languages of the United Nations (official languages of the European Union are Bulgarian, Czech, Danish, Dutch, English, Estonian, Finnish, French, German, Greek, Hungarian, Irish, Italian, Latvian, Lithuanian, Maltese, Polish, Portuguese, Romanian, Slovak, Slovenian, Spanish, and Swedish. Official languages of candidate countries are Croatian, Icelandic, Macedonian, and Turkish. Non-EU official languages of the United Nations are Arabic, Chinese, and Russian).

The periodicals will have to be delivered, according to the provisions of each subscription, to one of the addresses of the Directorate-General, namely either the Jean Monnet Building, rue A. Wehrer, 2920 Luxembourg, LUXEMBOURG, or rue de Genève 12, 1140 Evere, BELGIUM.
 6.Expiry date of the list resulting from the call for expressions of interest:
26.7.2013.Any economic operator interested may submit an application at any time during the period of validity of the list, with the exception of the last 3 months.
 7.Criteria for inclusion on the list:
7.1 Exclusion criteria:Candidates shall be excluded from participation in the call for expressions of interest if:(a) they are bankrupt or being wound up, are having their affairs administered by the courts, have entered into an arrangement with creditors, have suspended business activities, are the subject of proceedings concerning those matters, or are in any analogous situation arising from a similar procedure provided for in national legislation or regulations;(b) they have been convicted of an offence concerning professional conduct by a judgement which has the force of 'res judicata';(c) they have been guilty of grave professional misconduct proven by any means which the contracting authority can justify;(d) they have not fulfilled obligations relating to the payment of social security contributions or the payment of taxes in accordance with the legal provisions of the country in which they are established or with those of the country of the contracting authority or those of the country where the contract is to be performed;(e) they have been the subject of a judgement which has the force of 'res judicata' for fraud, corruption, involvement in a criminal organisation or any other illegal activity detrimental to the EU's financial interests;(f) they have been declared to be in serious breach of contract for failure to comply with their contractual obligations, following another procurement procedure or grant award procedure financed by the EU budget.In addition, contracts may not be awarded to candidates who, during the procurement procedure:(g) are subject to a conflict of interest;(h) are guilty of misrepresentation in supplying the information required by the contracting authority as a condition of participation in the contract procedure or fail to supply this information.Candidates must prove that they are not in one of the situations described above by producing the following documents:— in relation to items (a), (b) or (e), a recent (not dated more than 6 months prior to the date of this call for expressions of interest) extract from the judicial record or, failing that, a recent equivalent document issued by a judicial or administrative authority in the country of origin or provenance showing that those requirements are satisfied,— in relation to item (d), a recent (not dated more than 6 months prior to the date of this call for expressions of interest) certificate issued by the competent authority of the State concerned. Where no such certificate is issued in the country concerned, it may be replaced by a sworn or, failing that, a solemn statement made by the interested party before a judicial or administrative authority, a notary or a qualified professional body in his country of origin or provenance,— in relation to items (g) and (h), an affidavit stating that candidates are not subject to a conflict of interest and that they are supplying all the information required for the call for expressions of interest in good faith and without misrepresentation. This document should be signed by the person(s) empowered to represent the tendering party and sign contracts.7.2 Selection criteria:Place of establishment:Candidates must be established in a Member State of the European Union, or of the European Economic Area, or in one of the 4 candidate countries (Croatia, the former Yugoslav Republic of Macedonia, Iceland and Turkey), or in another State having concluded an agreement on public procurement with the European Union covering the relevant category of supplies, and furnish proof thereof in accordance with their national legislation.Status and legal form of the candidate:Candidates must indicate their complete business name, address and legal status, and provide appropriate proof thereof (VAT registration number, number of registration in a trade or professional register, copy of acts of foundation or incorporation, etc.).Economic and financial capacity:Candidates must provide proof of their economic and financial capacity by means of one or more of the following documents:— appropriate statements from banks or evidence of professional risk indemnity insurance,— balance sheets or extracts from balance sheets for at least the last 2 years for which accounts have been closed, where publication of the balance sheet is required under the company law of the country in which the economic operator is established; where such publication is not required, candidates may prove their economic and financial capacity by any other means which DGT considers appropriate,— a statement of overall turnover and turnover concerning the supplies covered by the call for expressions of interest over the last 3 financial years.Professional and technical capacity:Candidates must provide proof of their professional and technical capacity by means of the following documents:— a list of the main supplies delivered in the past 3 years, with the sums, dates and recipients (public or private),— a statement of the average annual manpower and the number of managerial staff in the last 3 years,— a description of the technical facilities, tools and equipment to be used to carry out the contract,— a description of the measures to be used to ensure quality of the supplies, such as claims functions, efficiency of delivery services,— a table outlining their catalogue of periodicals, including the following information:— title, type (general or specialised), format (paper or electronic — CD/DVD-ROMs, databases) and language of periodicals,— in the case of subscription to databases, a description of the database and its functionalities, such as accesses or updating,— in the case of subscription to CD/DVD-ROMs, their frequency of delivery, technical specifications to ensure ease of use, secure packaging,— for both types of subscription to electronic periodicals, support in case of technical questions or problems.
