Notice of a call for expressions of interest

 1.Authorising department:

 2.Type:
Notice of a call for expressions of interest. Undertakings or persons who are interested in applying for inclusion on a list are invited to do so, in accordance with the provisions contained in this notice and the purposes stated therein. The authorising department will include on the list all the applications meeting the criteria set out in point 9. When a specific public procurement contract covering the field in point 4 is becoming available, the authorising department will send the corresponding invitation to tender with the tender documents to all the candidates on the list or to those among them who have been selected using objective and non-discriminatory prequalification criteria specific to the contract concerned. Inclusion on the list does not bind the European Union in any way as regards either awarding a contract or, subject to the aforementioned, sending out an invitation to tender. Your personal data will be processed pursuant to Regulation (EC) No 45/2001 on the protection of individuals with regard to the processing of personal data by the Union's institutions and bodies and on the free movement of such data. Unless indicated otherwise, your replies to the questions and any personal data requested are required to evaluate your expression of interest and will be processed solely for that purpose by the Publications Office.  3.Type of contracts to be competed for on the basis of the list:
The list resulting from this notice will be used exclusively for public contracts of the following type: — service contracts under Annex IIA to Directive 2004/18/EC, except for research and development contracts in category 8 in that Annex worth less than the threshold in the Directive (as from 1.1.2012, the threshold is 130 000 EUR).
 4.Field covered by this call for expressions of interest:
Implementation, configuration, technical analysis and design, consultancy and dedicated support services related to Webtrends v8.x and later versions. This may consist of, among others, the installation and performance tuning on 'in situ' servers, page tagging of websites, integration of log file data into Webtrends, setting up and fine-tuning of custom reports, consultancy upon Webtrends and website statistics in general.
 5.Place where services are to be provided:
On the contractor's premises, on the Publications Office's premises or on the premises of another European Union institution or body, depending on the nature of the work. The Publications Office's premises are located in Luxembourg.
 6.Expiry date of the list resulting from the call for expressions of interest:
3 years from the date given in point 11. Interested parties can apply at any time prior to the last 3 months of the list's validity period.
 7.
 (a)Groupings:
Where a grouping is involved, the criteria in point 9 will apply both to the grouping as a whole and to its individual members for the exclusion criteria, and for the parts of the selection criteria which concern the professional competence and economic standing of the company but only to the grouping as a whole for the parts of the selection criteria which concern the technical capability. If the contract is awarded to a grouping, the latter must take on a legal form prior to contract signature if it will act as a sole service provider or designate 1 of its members as a group leader to represent the other members. The members of the grouping must be jointly liable for any contract with the European Union based on the list.
 (b)Subcontracting:
1. A candidate/tenderer wishing to make use of subcontracting has to submit for approval of the Publications Office the following documents: a) a declaration of honour, covering the exclusion criteria of point 9.1, signed by the legal representative of the proposed subcontractor; b) a letter of intent, signed by the legal representative of the proposed subcontractor, stating: a. the intention of the company to collaborate with the candidate/tenderer, if the latter is awarded the contract; b. roles and responsibilities of the subcontractor. The Publications Office reserves the right to ask for additional documents in order to verify whether the proposed subcontractor is not subject to exclusion. 2. The documents concerning subcontracting shall be submitted by the candidates/tenderers at the latest when submitting an offer in the future procurement procedure based on the list resulting from this call for expressions of interest. When submitting an offer, tenderers will need to state explicitly the proportion of the proposed subcontracted tasks (in %) against the total volume of the tasks to be assigned under the procedure in question. 3. Finally, if the subcontracting is approved by the Publications Office, the contractor remains fully liable towards the Publications Office for the proper performance of the contract as a whole. Accordingly: — the Publications Office will treat all contractual matters (e.g. payment) exclusively with the contractor, whether or not the tasks are performed by a subcontractor, — under no circumstances can the contractor avoid liability towards the Publications Office on the grounds that the subcontractor is at fault.
 8.
 (a)Address to which applications must be sent:

 (b)Procedures for the dispatch, delivery and submission of applications:
Candidates may choose to either send their application by post or to deliver it directly or via any representative of theirs, including private courier services. All the information and documents described in point 9 must be enclosed with the application. The following must be written on the envelope: 'AMI — 2012/1/OP/Webtrends'. Candidates must also write their name on the envelope. Candidates will receive an acknowledgement of receipt, no later than 4 weeks from the date on which they send their dossier, notifying them if their application has been accepted.
 (c)
The file must contain all the documents needed to prove the candidates' fitness for inclusion on the list in terms of the criteria given in point 9.
 (d)
The following documents are available on the website http://publications.europa.eu/tenders/our/index_en.htm of the Publications Office under the title 'Calls for expressions of interest': — declaration of honour, covering the exclusion criteria of point 9.1, — identification form, covering point 9.2(a) of the selection criteria.
 9.Exclusion and selection criteria
 9.1Exclusion criteria:
Candidates or tenderers will be excluded from participation if they: a) are bankrupt or being wound up, if their affairs are being administered by the court or if they have entered into an arrangement with creditors, if they have suspended business activities, if they are the subject of proceedings of this nature or if they are in any analogous situation arising from a similar procedure under national laws or regulations; b) have been convicted of an offence concerning their professional conduct by a judgment which has the force of 'res judicata'; c) have been guilty of grave professional misconduct proven by any means which the contracting authorities can justify; d) have not fulfilled their obligations regarding the payment of social security contributions or taxes in accordance with legal provisions in their country of residence, or those of the country of the contracting authority or those of the country in which the contract is to be carried out; e) have been the subject of a judgment which has the force of 'res judicata' for fraud, corruption, involvement in a criminal organisation or any other illegal activity detrimental to the EU's financial interests; f) are the subject of an administrative penalty for being guilty of misrepresentation in supplying the information required by the contracting authority as a condition of participation in the procurement procedure or for failing to supply information, or for being declared to be in serious breach of their obligation under contract covered by the budget. Candidates must attest that they are not in any of the aforementioned situations. The contracting authority may ask for evidence concerning this information if there is doubt if the tenderer to whom the contract is to be awarded is in one of the situations of exclusion.
 9.2Selection criteria:
The assessment of professional competence, economic standing and technical capability will be based on the following information and documents which must be submitted by candidates, demonstrating their knowledge and/or the experience in the domain: a) an identification sheet for the firm stating the corporate name, legal status, address, telephone and fax numbers, VAT number and bank details; b) a clear statement that the whole range of services in point 4 can be covered and the lowest value at which they will consider any contract for which they wish to be consulted; c) a brief note giving details of their activities; d) a minimum of 2 CVs submitted, each demonstrating minimum 200 man-days of experience in the relevant field; e) a list of the services mentioned under point 4 provided over the last 3 years. The following details must be given for each service/project: brief description of the service/project, overall volume in man-days, start and completion dates, customer's particulars, working language(s) used, and number of man-days per profile and per activity type; f) specific requirements: A presentation of at least 2 successful Webtrends installations (in any of the versions of Webtrends) that the candidate has implemented/configured over the last 3 years being in production and, if possible, accessible via the Internet. 1 project may cover several of the specific requirements listed below. To be eligible the candidate has to indicate at least 2 different projects, which cover together at least 4 of the specific requirements listed below. In addition, the total contribution of the candidate's own staff for all projects presented must be at least 150 man-days. The specific requirements: — the installation and performance tuning on servers installed at the client's premises, — page tagging of websites, — integration of log file data sets (1 successful example is sufficient), — setting up and fine-tuning of custom reports, — consultancy upon Webtrends and website statistics in general.
 10.Additional information:
The attention of interested parties is drawn to the aim of this notice, i.e. the compilation of a list of candidates likely to be invited to respond to individual invitations to tender. Therefore, they are requested to send the information required in point 9 in accordance with the procedures given in point 8 and to refrain from seeking further information at this stage. When a contract is to be awarded, the authorising department — acting on the basis of objective and non-discriminatory selection criteria specific to that contract — will invite at least 5 preselected candidates to submit a tender, provided a sufficient number of candidates satisfy the selection criteria, and will send them the tender documentation. The number of candidates invited to take part is limited to a maximum of 20.
